TERMS, CONDITIONS and PRIVACY POLICY
1. COPYRIGHT

Richard Stanton never signs away copyright to any of his work. He will license the use of images to clients according to their requirements and subject to agreed fees. Therefore, please note that all images, text and logos on this site are the property of Richard Stanton and are protected by the copyright laws of the United Kingdom as well as international copyright laws and treaties.

If you are in receipt of images created by Richard Stanton, note that the work’s creator retains exclusive copyright at all times and publication, syndication or offering the work for future publication without Richard’s knowledge or agreement is in breach of the ‘Copyright, Designs and Patents Act 1988’, (Part 1, Section 4, 2b).

Richard Stanton vigorously protects his copyright interests and any infringement of his interests will always be pursued through a court of law.

The images on this site are for web browser viewing only and may not be reproduced, copied, stored, downloaded or altered in any way without the explicit written authorisation of Richard Stanton.

The use of any image owned by Richard Stanton in part or in whole for other forms of artistic expression is a violation of copyright. No images reproduced on the pages of this site are in the public domain.

The use of any images or other materials herein published, in whole or part, for any purpose including copying, reproduction, publication, transmission, manipulation, projection, used as the basis for any other photograph or illustration, or downloading and storing in any way is prohibited, without written permission from Richard Stanton.

2. CANCELLATION POLICY

A booking is made upon receipt of verbal or written confirmation of commission, and accordingly Richard Stanton will, at his discretion, charge a fee for cancellation or postponement of a commission if the client does not give reasonable notice.  

3. REQUESTING IMAGES

Whether you are the subject of commissioned photography or an interested party in images shot by Richard Stanton, and you would like to have a selection of images from a given photographic shoot supplied to you, the following terms apply: –

Low-resolution images will be sent to you (not, images may not be available before the commissioner of the photography has published the works.)

If you decide to order prints or license photography for use on a website, in a magazine, for publication etc., a fee will need to be agreed.

3a. ORDERING PHOTOGRAPHIC PRINTS, CANVASSES ETC

Richard Stanton can arrange and undertake for you the production and delivery of conventional photographic print images after a shoot. He can supply (unless stipulated by any other contractual agreement entered into with the commissioning client) conventional photographic prints, canvas wraps, aluminium mounted large format prints etc., in a variety of finishes and sizes with competitive prices available on request.

3b. ORDERING DIGITAL IMAGES

If you would like to receive a digital copy of an image so that you can later print it at home or use it on your Facebook page or personal website for example, please do call or email for further details.

4. RE-ORDERING DELIVERY OF PREVIOUSLY COMMISSIONED PHOTOGRAPHY

If a commissioning client loses images previously shot and supplied to deadline and in accordance to the given brief and licensing agreement entered into, a fee may be chargeable for resending to cover the time and effort it takes to search the library, prepare the digital media and deliver the images requested.

5. CITATION – RIGHT TO BE IDENTIFIED

According to the terms of the Copyright, Designs and Patents Act 1988 relating to Moral Rights, Richard Stanton has the right to be identified as the works’ creator at all times. Where possible ‘Richard Stanton’ is to be credited (by-line) as the ‘Author’ of the images. The right to a credit is asserted in accordance with sections 77 and 78 of the aforementioned Copyright, Designs and Patents Act 1988.

6. PAYMENT TERMS

Richard Stanton’s payment terms are strictly 21 days from the date of his invoice. Persistent late payers will become subject to the terms and conditions of the Late Payment of Commercial Debts (Interest) Act 1998.

7. ‘DUMP & RUN’

Occasionally clients request that Richard Stanton hands over all the unedited and unadjusted digital files shot on a commission, however Richard Stanton strictly follows the guidelines as defined by the NUJ in relation to this matter. They state: “The “straight from the camera” supply of digital files is deeply unsatisfactory for photographers and clients, and the practice of handing over the entire contents of a camera card for the commission fee – commonly referred to in justly unflattering terms as a “Dump and Run” – cannot be endorsed or encouraged by the NUJ and is considered unprofessional.

“The client gets unedited digital files, including all the under and overexposed frames, the unsharp frames and all the “indecisive” moments. Moreover, digital files that are correctly exposed but otherwise uncorrected or processed in imaging software like Photoshop rarely match the quality of original prints or transparencies, or the scans photographers used to make from them.

“It also provides no way of tracking image usage, due to the amount of files handed over, lack of captions or photographer credit on each file, and with widespread ignorance about the licensing of images, constitutes a virtually “Royalty Free” handover of images from the photographer without appropriate payment…

“Photographers take pride in providing an edited selection of colour corrected, sharpened & captioned photographs – in short, working professionally – the way they always have, by presenting an edited, processed, captioned set of prints, transparencies and now… digital images.

“So professionally prepared files are the best way of supplying photographs for both photographer and client – they are after all exactly what the client previously received in the form of prints, transparencies or scans from film.”

8. LICENSED USAGE

When a client commissions photography they are granted an agreed license to use the images for a fixed use and usually for a fixed duration– e.g., in a publication (newspaper, magazine, website etc…) or for commercial / PR uses (a banner, display panel, flyers / leaflets, syndication to 3rd party media etc…) for 3 months, 6 months or 1 year etc.

Clients do not ‘own’ the images – Richard Stanton retains ownership and copyright of his works at all times. Clients should discuss the licensing of images at the point of commissioning and not assume they have unrestricted use of images supplied forever. In the event of any client being unsure of the terms they have entered into, section 1. COPYRIGHT (see above) will be the default and overriding agreement for the terms and conditions of both image ownership and licensing for a single ‘one off’ use.

9. MODEL RELEASE & CLEARANCES

As the photographer, Richard Stanton accepts no liability for non-supply of pictures for whatever reason relating to model release or clearances. It is the client’s / publisher’s responsibility to ensure that all the necessary clearances have been obtained to allow the pictures to be taken without hindrance or infringements of trademarks, copyrights or personal rights.

10. PROFESSIONAL INSURANCE

As a professional freelance photographer Richard Stanton has comprehensive public liability insurance, product liability cover, professional indemnity and personal accident insurance.  These are industry specific, specialist insurances.
